Points forts

Initiated an ICC arbitration for David Arelle Seargent against Tesla Energy over payments under a Stock Purchase Agreement and, after receiving a partially favourable award that also ordered reimbursement to Tesla, successfully pursued a partial annulment in Mexican court on grounds of public policy violations and improper tribunal constitution—an outcome now under review by the Mexican Supreme Court in a precedent-setting amparo proceeding.
Defended Eólica Tres Mesas 1 y 2 in an arbitration initiated by Abengoa over alleged contractual breaches, filing a counterclaim for non-performance that led to a favourable ruling for Eólica Tres Mesas 1 y 2, and subsequently secured an auto de exequendo from a Federal Court in Mexico City—setting a key judicial precedent in Mexico for the enforcement of arbitral awards.
Obtained a favourable ICC arbitration award for AES Mérida III against Comisión Federal de Electricidad (CFE), and initiated recognition and enforcement proceedings before the Federal Courts, while CFE simultaneously sought annulment of the award; both proceedings remain pending, alongside a separate challenge by CFE to the Federal Court’s revocation of interim measures previously granted during the arbitration.
